Adjudication is becoming more and more important in modern democracies. Citizens are more aware of their rights and are prepared to initiate legal proceedings, especially since the state does not seem capable to honor all their demands. At the same time the judiciary is increasingly scrutinized and critizised as adjudication has become increasingly transparent. To meet the demand for more litigation and the criticisms, the (organization of) the judiciary is undergoing rapid changes. The subject of this course is the reorientation of the judiciary. This includes the organization of the judiciary, the promotion of effectiveness, the development of quality control systems and specialization. The aim of this course is to discuss the role of the judiciary and adjudication in Dutch society.

Aspects of the adjudication that will be discussed include:
•    The constitutional quality of adjudication: judicial independence and impartiality
•    The organizational quality of the judiciary: efficiency and quality control
•    The quality of the legal service offered by the judiciary: the role of judges in alternative dispute
      resolution, the way parties are treated, the relation with the media
•    The competence of the judiciary: the demand for specialization, unity of adjudication
•    The role of adjudication in society: To what extent is the judiciary able to adapt to new
      developments? Should justice be done by lay-men and should jury-trial be introduced in the
      Netherlands
•    Professional ethics of the judiciary
•    Alternative Dispute Resolution
